DIVORCE MEDIATION

I am committed to the mediation process so that I can help prevent children from becoming the walking wounded. In addition this process prevents families from experiencing financial crisis that often occurs when the courts and individual family lawyers become involved.

 Getting Started

  • DEFINE THE RULES OF ACCEPTABLE COMMUNICATION IN ORDER TO QUALIFY FOR MEDIATION.

  • REVIEW AND DEFINE EXPECTATIONS

  • MEET AND CONFER WITH DIVORCING COUPLE TO ASSESS IF APPROPRIATE CANDIDATES

  • EVALUATE IF COUPLE IS READY TO DIVORCE: DEAL WITH OUTSTANDING UNRESOLVED ISSUES THAT COUPLE NEEDS TO RESOLVE IN ORDER TO BEGIN MEDIATION.

  • DIVORCE EDUCATION: HOW DOES MEDIATION WORK,  WHAT CAN BE NEGOTIATED,  WHY TO AVOID COURT, DEFINE GENERAL FAMILY LAW TERMS, DISCUSS LEGAL REPRESENTATION, REVIEW CONTRACTUAL LIMITATIONS OF MEDIATION,  DISCUSS THE EMOTIONAL AND PSYCHOLOGICAL IMPLICATIONS OF DIVORCE AND HOW TO AVOID THE PITFALLS, EDUCATE CHILDREN REGARDING THE PROCESS.

  • NEGOTIATE CUSTODY ARRANGEMENTS, SPLITTING UP THE ESTATE, DIVIDING FINANCES, HOUSEHOLD AND PERSONAL ITEMS, GENERAL DISCUSSION ABOUT SPOUSAL AND CHILD SUPPORT.

  • CREATE A COLLABORATIVE TEAM OF PROFESSIONALS AS INDICATED OR MAKE DIRECT REFERRAL TO FAMILY LAWYER, FORENSIC ACCOUNTANT, PSYCHOLOGICAL SERVICES, ETC.

For those who decide to divorce I remain committed to helping them navigate through the process. I have developed my own form of mediation that allows families to prepare for the separation with dignity if possible. I spend the time working out custody arrangements and educating the adults and children about the divorce experience. My goal is to keep families out of the court system. I work with the couple on dividing up the estate. I often will bring in accounting and legal consultants when necessary.
